STANDARD CONDITIONS OF HIRE for APPLESHAW VILLAGE HALL


For the purposes of these conditions, the term HIRER shall mean an Individual HIRER or where the HIRER
is an Organisation, its Authorised Representative (who in either case shall be older than 18 years of age).

The Hall is licensed for 150 people (standing) or 100 (sitting) and Hirers must not exceed these restrictions.

The Health and Safety file is located in the kitchen cupboard underneath the wall mounted water boiler.
Please do not remove this from the premises.

Hirers will be expected to recognise that there is a duty on them to comply with the all safety requirements set out in this hiring agreement and with safety notices on the premises and to accept responsibility to do everything they can to prevent injury to themselves or others.

SMOKING IS NOT PERMITTED ON THE PREMISES

1. The HIRER shall use the Premises during the agreed Period of Hire for the stated Purpose of Hiring and is to state during the booking process if alcohol is to be sold on the premises. The HIRER shall not permit alcohol to be supplied to anyone aged under 18.

2. LICENSING ACT 2003 – Licensable Activities: the HIRER hereby accepts the 4 fundamental objectives of the Act, namely (a) the prevention of crime and disorder; (b) public safety; (c) the prevention of public nuisance and (d) the protection of children from harm. A fuller explanation of the Act’s requirements is on the noticeboard in the Main Hall. The Hall’s Premises Licence allows sales of alcohol for consumption ON the premises only. Our premises do not include the Ward Memorial Playing Field.

3. Phonographic Performance Licence (PPL) for the playing of recorded music: commercial organisations and individuals who hire the Hall and earn an income from the activity MUST hold a PPL if they wish to play recorded music. They will not be covered by the Hall’s PPL..

4. The Committee permits the HIRER to occupy the Premises immediately before and after the agreed times for the purpose of setting up and cleaning.

5. The HIRER will be responsible for supervision of the Premises, all the Fixture and Fittings contained therein, their care, their safety from damage and the behaviour of all persons using the premises, whatever their capacity, including proper supervision of car parking arrangements so as to avoid obstruction of the highway. The HIRER is responsible for insuring his own personal effects.

6. * DEPOSIT: The HIRER shall pay a Damage Deposit of £30.00 (£100 for adult parties and discos and £50 for hire of tables and chairs only) in case of, for example, damage to the Premises or the Furniture and Fittings. The sum reserved by this clause shall not be the limit of the liability of the HIRER to the Committee in the event of serious misuse of the Premises or the Furniture and Fittings. The Committee will repay this sum in full within 14 days after the Period of Hire has expired subject to an inspection of the Premises by the Committee’s Authorised Representative.

7. The HIRER shall not use the Premises for any other purpose than described in the Hiring Agreement, nor sub-let, or use the Premises or allow the Premises to be used for any unlawful purpose nor do anything or bring anything onto the Premises which may endanger the same or render invalid any insurance policies in respect thereof.

8. The HIRER shall ensure nothing is done on or in relation to the Premises in contravention of the law relating to gaming, betting and lotteries.

9. FIRE SAFETY: the HIRER shall ensure that he/she is aware of the location and proper operation of fire fighting equipment, appropriate escape routes and the location of Fire Exits and the need to keep them clear. The HIRER shall ensure that all emergency exits are pointed out to visitors and are unlocked throughout the hiring and locked back up at the end of the hiring session.

10. DO NOT operate or touch any electrical equipment where there are signs of damage, exposure of components or water penetration. Please report this to the booking clerk.

11. DO NOT work on steps, ladders or at height until they are properly secured and another person is present.

12. DO NOT leave portable electrical or gas appliances operating while unattended.

13. DO NOT attempt to move heavy or bulky items (eg stacked tables or chairs) - use the trolley provided for the chairs.

14. To avoid toppling hazards please DO NOT pile equipment too high in the kitchen and storage room.

15. Please report any evidence of damage or faults to equipment, fixtures and fittings to the booking clerk.

16. To avoid slipping hazards please mop spills up immediately.

17. The Committee does not provide First Aid cover: the HIRER is responsible for providing this along with a First Aid Kit appropriate to current legislation.

(a) Report any accident in the accident book located in the kitchen cupboard under the wall mounted water boiler

18. KITCHEN: the HIRER is to follow the Instructions [kept in the cupboard under the water boiler] for the use and care of the dishwasher, cooker, refrigerator and microwave oven. If applicable, the HIRER may switch on the hot water boiler at the start of the hiring period but must switch it off before leaving the building. DO NOT attempt to carry or tip the large water boiling devices when they contain hot water. Leave to cool

(a) DO NOT allow children in the kitchen except under close supervision. Avoid overcrowding in the kitchen.

19. The HIRER shall, if preparing, serving and/or selling any food, observe all relevant food health and hygiene legislation and regulations. If the HIRER arranges sub-contracts for the supply of food and drink, he shall ensure that his/her sub-contractor complies with these regulations.

20. If the HIRER uses any electrical appliances on the Premises, these shall be used properly and be safe and in good working order. DO NOT bring onto the property any portable electrical appliances which have not been Portable Appliance Tested.

21. The HIRER shall indemnify the Committee for the cost of repair of any damage done to any part of the Premises including the curtilage thereof or to the Fixture and Fittings, which may occur during the Period of Hiring or as a result of the Hiring.

22. CANCELLATION OF BOOKING: If the HIRER wishes to cancel the booking, the following shall apply: up to 7 days before the event, the total fee and deposit will be refunded; from 7 days to 24 hours before the event, 50% of the fee will be refunded; less than 24 hours before the event, no refund.

23. The Committee reserves the right to cancel this hiring in the event of the Premises being required for use as a Polling Station, in which case the HIRER shall be entitled to a refund of any monies paid.

24. The committee reserves the right to cancel this Hiring Agreement at any time upon giving seven days’ notice to the HIRER. The HIRER shall be entitled to reimbursement of any monies paid, but the Committee shall not be liable to make any further payments to the HIRER.

25. The HIRER shall respect the needs of local residents and leave the premises and the area quietly.

26. WASTE/GLASS: the HIRER shall ensure that the Hall is left clean and tidy. Empty glass receptacles/bottles must be separated from the general rubbish. HIRERS’ WASTE MUST BE TAKEN AWAY WITH THE HIRER AND DISPOSED OF OFF-SITE, OTHERWISE £10 WILL BE DEDUCTED FROM THE DEPOSIT.

27. The HIRER shall ensure that any activities of children under eight years of age comply with the provisions of the Children’s Act 1989.

28. DOGS: no dogs are permitted inside the Hall building unless by prior arrangement, in which case they must be clean and kept under control.

29. At the end of the Period of Hiring, the HIRER shall be responsible for leaving the Premises and surrounds in clean and tidy condition, the Furniture and Fittings cleaned and in their proper place, and properly locked and secured, otherwise the Committee shall be at liberty to make an additional charge.

30. In the event that at the Premises or any part thereof are rendered unfit for hire, the Committee shall not be liable to the HIRER for any resulting loss or damage whatsoever.

31. The Committee retains the right or any person acting on their behalf to attend and enter the premises at any time during an event to ensure that legal and booking conditions are being complied with. Should any breach be found, this will be brought to the immediate attention of the HIRER.

32. Community Events: At the discretion of the trustees certain community events will benefit from a nominal charge of £1 per head attending to cover the costs of heating, lighting and cleaning.
